Pre-Bid Meeting Details: A SECOND mandatory pre-proposal Meeting will be held on the 20th day of June 2023, at 10:00 a.m. at the Project Site. Please arrive early and check in at the front office. Any contractor arriving more than 5 minutes late will not be permitted to attend. Any contractor that attended the pre-proposal meeting that was held on 6/13/2023 is NOT required to attend the second meeting. ______________________________________________________________________________________ Any Contractor who intends to submit a Proposal is required to attend a mandatory Pre-Proposal Meeting, which will be held on the 13th day of June 2023, at 10:00 a.m. at Northwest Whitfield High School located at 1651 Tunnel Hill Varnell Road, Tunnel Hill, GA 30755. Please arrive early and check in at the front office. Any contractor arriving more than 5 minutes late will not be permitted to attend.

Question: Section 3.1.2 (P40) Request the addition of the following language to section 3.1.2 “Liquidated Damages shall not apply if the delay is a result of, or occasioned by a Force Majeure event or circumstance beyond the control of the Contractor as defined in section 8.3.5.”
Response: Time extensions are granted under 8.3.5 – disputes concerning entitlements to time extensions do not carry liquidated damages as time extensions eliminate liquidated damages.

Question: Request addition of Section 6.4 Notice to Proceed (P49) - “Owner Shall issue Notice to proceed for commencing the work no later than 60 days following the Notification of the Award of this agreement. or to allow the selected Contractor to modify the bid price, should the owner not provide notice to proceed (NTP) within 60 days of the notification of award of the contract.
Response: Answer: If the NTP is not initiated within 60-days, the parties can negotiate payment for any demonstrable increase in costs. If no agreement is reached, 12.2.1 gives us the right to terminate for convenience.

Response: Yes, in the above case, time will be added per section 8.3.5. Please note, time added to the contract is non-compensable.

Question: Have the materials specified for disposal been tested at any time over the previous 10 years for PFAS / PFOA or other 40 CFR 503 regulated components? If so, would the County be willing to share the results of these test results? Does the County have any plans to test the materials specified in the agreement for PFAS /PFOA or other 40 CFR 503 regulated components during the duration of the contractual agreement term?
Response: The sludge was analyzed for TCLP Volatile Organic Compounds (VOCs), TCLP Semi-Volatile Organic Compounds (SVOCs), TCLP RCRA Metals, Total Polychlorinated Biphenyls (PCBs), Paint Filter Test, and % Solids in August 2019 as requested by the Dalton-Whitfield Landfill. No PFAS / PFOA analysis has been done. No additional sampling or analysis is planned at this time unless it is required by the receiving landfill.

Response: Unfortunately, this area will not be available. It is utilized for football games in the fall.
