Description:

Section 44-96-80(J) of the South Carolina Solid Waste Management and Policy Act of 1991 (the Act) gives the governing body of each county the responsibility and authority to provide for the management of solid waste within its borders. The Act states that a county has “the responsibility and authority to provide for the operation of solid waste management facilities to meet the needs of all incorporated or unincorporated areas of the county.”

Section 44-96-20 of the Act “establishes goals for solid waste diversion from municipal solid waste (MSW) landfills and recycling on a statewide basis, and confers upon counties the responsibility for establishing solid waste management plans, including ordinances, policies and regulations, which support the achievement of the established waste reduction goal and recycling goal.” In 2011, the South Carolina Department of Health and Environmental Control updated the state goals to 1) recycle 40 percent or more of the Municipal Solid Waste generated in the state and 2) to reduce the average disposal of Municipal Solid Waste to 3.25 pounds per person per day or less. Beaufort County supports these goals.  

Section 62 of the Beaufort County Code of Ordinances contains the provisions for solid waste management and recycling in the unincorporated area of the County and at all county solid waste facilities. All Proposers shall be familiar with this Section as the provisions will apply to Contractors. Section 62-2 states that the County “shall provide for the management, collection, and disposal of solid waste.” Section 62-48 states that “Franchises may be awarded for the unincorporated areas of the county incrementally, when approved by county council.”  

As the County population grows, Beaufort County strives to continue to manage solid waste in an environmentally sound, equitable, and cost-effective way. To this end, the Beaufort County Council passed Resolution 2016/9 on May 23, 2016, which directed staff to begin the process to implement curbside collection of residential waste and recyclables throughout unincorporated Beaufort County.

Question: Greetings, The following are questions arising from the per-solicitation meeting held on the 16th of August: 1. Has the October 4, 2018 deadline been ofically postponed? 2. Would the County allow for a default agreement that transfers ownership of the garbage and recycling carts directly to the County in lieu of a performance bond? 3. In the event that a resident defaults on payment for additional services can the base service be suspended or will the County assist in the collections and recovery of lost revenue? 4. What are the standards that a community must adhere to in order to exempt itself from the County program? 5. What is the procedure that communities will need to follow to exempt themselves from the County program? 6. Will the contractor selected for the district still be paid the monthly unit base rate for units that reside in exempted communities? 7. Will haulers who are physically located inside of the County be given additional points for being a local business? Sincerely, Jim Lewis

Question: 1. What are the exact requirements a community must meet to be exempt from the county program? 2. Will said community also be essentially paying for the counties’ program even if they are exempt through their taxes? 3. If this is true will the hauler working the community be required to cover landfill fees or will it be covered through the taxes? 4. How are you going to control the cost of fees paid to Waste Management to drop recycling? They are currently $100+ and keep going up. The county forces us to offer recycling, why doesn’t the county cover these costs? 5. Will an exempt community be required to have the county mandated cans? 6. Do extra points go to local haulers who are based in Beaufort County? 7. Do extra points go to a “Disabled Veteran Owned Business”? 8. Are you going to postpone the bid deadline as you suggested in the pre-solicitation meeting? 9. When this goes into effect how will you handle the landfill fees for HHI? Are you going to still cover the cost?

Question: I have read the previous questions and your responses for communities to opt out, and I wanted to make sure I understood for clarification purposes. 1. In order for a community to submit to be opted out, they must require every home to have waste and recycling service? 2. If that community is allowed to opt out of the County program, I understand they will have to pay the hauler directly for services. While I know the County currently charges on taxes for disposal and other solid waste function, I understand the County plans to add charges to cover the cost of the curbside program to each home. So, in a community that is allowed to opt out of the County program, they will pay the hauler and also pay the current fees charged on taxes, will they also be required to pay for any other fees that are added to the taxes to cover the County curbside program ( In other words, they would be paying twice for the same service)?
