shall be liable for and shall pay the Owner the sums hereinafter stipulated as
liquidated damages, and not as a penalty, for each calendar day of delay after
the date established for Substantial Completion in the Contract Documents until
the Work is substantially complete: One Thousand Dollars ($1,000.00)

P1.2.8 Article 9.11 is further amended to state as follows:
The Contractor and the Contractor’s surety acknowledge that the Contractor’s
failure to achieve Substantial Completion of the Work by the dates established
in the Contract Documents will cause the Owner to incur substantial economic
damages of types and in amounts that are impossible to compute and ascertain
with certainty as a basis for recovery by the Owner of actual damages, and that
liquidated damages represent a fair, reasonable and appropriate estimate
thereof. Accordingly, in lieu of actual damages for such delay, the Contractor
agrees that liquidated damages may be assessed and recovered by the Owner
against the Contractor in the event of delayed completion and without the Owner
being required to present any evidence of the amount or character of actual
damages sustained by reason thereof. Therefore, the Contractor shall be liable
to the Owner for payment of liquidated damages in the amount of Three Thousand
Dollars and Zero Cents ($3,000.00) per calendar day that Substantial Completion
is delayed beyond the dates established in the Contract Documents. Such
liquidated damages are intended to represent estimated actual damages and are
not intended as a penalty, and the Contractor shall pay them to the Owner
without limiting the Owner’s right to terminate this Agreement for default as
provided elsewhere herein

Question: The existing Interior storefront that will require glass type SG-2 is designed to only hold glass up to 3/8" thick. The Glass called out (School Guard SG5) is a min.of 1-1/8" thick. This will require us to cap off the existing glazing pocket and install an aluminum sash that will accept that glass thickness. Can a smaller glass be used in the existing storefront frames or will an aluminum sash be acceptable?
Response: I think they might be looking at the IGU (insulated glass version), but we are calling for the monolithic version. Glazing Type SG-2 replaces single pane glass at the interior of the vestibules. I have attached the data sheets SG5, and SG4 which will be accepted if SG5 won’t fit the in the existing glazing channels. Todd Powers - Please see attachments in our additional information.
