Description: Calhoun County has received a U.S. Environmental Protection Agency (EPA) FY 2021 Brownfield Cleanup Grant to address contamination at the Calhoun County Justice Center property. The property is located at 161 East Michigan Avenue, Battle Creek, MI. The purpose of the U.S. EPA Cleanup Grant funds is to assist the County in remediating hazardous substance contamination at the site to allow for redevelopment.
Calhoun County is requesting bids from qualified contractors to provide the cleanup activities described herein. The selected firm will be subject to federal contract requirements, including, but not limited to, Minority Business Enterprise/Women’s Business Enterprise (MBE/WBE) program, project certification process, and minimum Federal (Davis-Bacon) wage rates, where applicable.

Pre-Bid Meeting Details: Please sign up if you plan to attend the pre-bid meeting.A pre-proposal conference will be held at the George W. Toeller Building, 190 E. Michigan Avenue, Battle Creek, Michigan for the purpose of reviewing the project site. The conference will be held on TUESDAY, APRIL 11, 2023 @ 10:00 A.M. Bidders are to enter the building from the Public Entrance, located on the north side of the building. Public parking is available on the north side of the building. The meeting will be immediately followed by a tour of the project site. Representatives of County Administration and Community Development will be present to discuss the project, bidding requirements and project sequencing requirements. Attendance at the pre- proposal conference is strongly encouraged in order for the bidder to submit a bid.

Question: On sheet 17 Paragraph 2.4, you are asking for a bid bond of 100% of the contract value, i believe there may be some confusion as usually performance and payment bonds are 100% and the bid bond is 5%. I did check with my bonding company and they said that they have never seen a 100% bid bond before.

Question: What is the proposed schedule for this project?
Response: Thank-you for your question. Work can begin upon approval of a contract by the County Board of Commissioners which is proposed to occur on 5/18/23. Project completion must occur by 8/31/2023, including all restoration activities complete, demobilization complete, invoices submitted with appropriate backup documentation, etc. If an alternative timeline would result in better cost, please propose alternative schedule.

Question: The spec is unclear if the contamination levels are going to classify the soils as hazardous waste. Do you have analytical data for the soils?
Response: Thank-you for your question. A copy of a Phase II ESA report, dated November 25, 2019, is appended. The Phase II ESA report summarizes the analytical results of soil samples collected from the mound. In addition, a waste characterization sample was collected from the mound in 2019; a copy of the laboratory analytical report is appended. Based on the waste characterization sample analytical results, it is assumed the soil is not considered a hazardous waste and will be accepted for disposal at a Type II licensed disposal facility. Please note, based on the age of the previous analytical results, the contractor should assume they will need to complete the waste characterization process again (collection of representative sample and laboratory analysis) to complete the disposal approval process at a Type II licensed disposal facility and should include costs in their bid.

Question: 1) Are there any liquidated damages? 2) Is there an approximate start and end date? 3) Do the stumps need to be hauled to the landfill?
Response: 1) 5% bond and no liquidated damages. 2) Work can begin upon approval of a contract by the County Board of Commissioners which is proposed to occur on 5/18/23. Project completion must occur by 8/31/2023, including all restoration activities complete, demobilization complete, invoices submitted with appropriate backup documentation, etc. If an alternative timeline would result in better cost, please propose alternative schedule. 3) The contractor is responsible for clearing the site. Brush and trees will be removed from the site at the contractor’s discretion; however, stumps need to be segregated and disposed at a Type II licensed disposal facility.

Question: During the pre-bid meeting, it was mentioned that a professional would be onsite doing continuous testing on the soil as the job is in progress. If there is contamination found that is currently unknown, what is the protocol for getting this resolved? If there is more expense involved, this would require a change order to be submitted to cover the additional expense.
Response: The Professional will be responsible for determining if additional contamination is present that needs to be handled differently than the presented scope of work. If the Professional determines that a new scope of work is required, it is understood that the contractor would present a change order to the County at that time.

Question: On Page 20 of 51 of the RFP 124 Soil Removal document, it indicates that the fill material can contain "volatile organic compounds, polynuclear aromatic hydrocarbons, and metals". Are any of the over the characteristic US EPA Waste Code limits? Can you provide a copy of the analytical provided by the Consulting Firm? If not, please confirm that ALL of this waste will be characterized as non-hazardous solids.
