Question 1

Posted: 4/15/2022

Question: Is this project just for contractors or is there design involved? We do MEP/FP design engineering? Also, I don't see an RFP or RFQ? Is this simply a straight bid? Please let me know when you get a chance. Thanks. Jan Gerald Groupp, NBA Engineering, (415) 225-9733, jgroupp@nbaeng.com

Response: Is this project just for contractors or is there design involved? Reply: Just for contractors. Design is complete. We do MEP/FP design engineering? Reply: No design engineering required. Also, I don't see an RFP or RFQ? Is this simply a straight bid? Reply: Yes, straight bid.

Question 2

Posted: 4/22/2022

Question: I am emailing you today about the above named project. On Plan Sheet S/L-102 the tree table lists a variety of trees to be removed; however, the drawings do not always match the tree table, notably Tree #46 in the drawings says it is not to be removed but it does in the tree table. In addition, Plan Sheet S/C-101 there are trees identified to be removed that do not match Plan Sheet S/L-102 drawings or table. Please clarify the amount and which trees are to be removed.

Response: The Landscape Architect has reviewed the civil demo sheet S/C-101 and on sheet S/L-102 there are three trees that were mislabeled on the plans. Tree numbers 37, 38, and 46 should be removed. The plans will be updated accordingly. Note that tree number 11 should be removed and trunk wood salvaged for reuse per sheet S/L-102.

Question 3

Posted: 4/25/2022

Question: State law requires that we provide the DIR registration number for each listed subcontractor on bid day. There’s no space for the DIR number on the Designated Subcontractor List. Will you be revising it? If you do revise – please consider adding 1 sheet in between pages 1 and 2 that is just for sub listings, so that we all may duplicate that page for our bid rather than duplicating page 1 or 2 which have much less lines for sub listings).

Response: 00 21 13 Instructions to Bidders requires submission of 00 43 36 Designated Subcontractors List with your bid. The awarded bidder receives document 00 51 00 Notice of Award, which requires submission of 00 45 49 Registered Subcontractors List, where the DIR # is required.

Question 4

Posted: 4/25/2022

Question: There is a Buy American Certification (00 45 46.09) in the Div 00 & 01 Project Manual. Is this project subject to Buy American or is this leftover boilerplate language?

Response: This project is not federally funded. However, document 00 45 46.09 Buy American Certification needs to be completed and submitted by the awarded contractor.

Question 5

Posted: 4/25/2022

Question: Special Conditions Item 12 mentions Federal Funding. Is there Federal Funding for this project or is this leftover boilerplate language? If there is Federal Funding, is it specific to a particular increment? If it is, which one? Also, does Federal Prevailing wage apply and if it does – to which increment?

Response: This project is not federally funded. Item 12 on document 00 73 13 Special Conditions does not apply here, but is boilerplate language that should have been removed.

Question 6

Posted: 4/25/2022

Question: Are MEP and Fire Sprinkler subcontractors required to be prequalified? If they are, by when? And could you provide an updated list of them?

Response: No, MEP and other subcontractors are not required to be pre-qualified. Only the GC needs to be pre-qualified.

Question 7

Posted: 4/25/2022

Question: When will the final list of prequalified general contractors be posted?

Response: Quality Bidders states that the Approved List of Responsible Bidders will be announced 05/10/2022.

Question 8

Posted: 4/25/2022

Question: The insurance requirements in the General Conditions Section 13 mention builders risk insurance and that earthquake and flood are required. Please let us know if this is correct or just leftover boilerplate language. Also, please let us know if the Public Contract Code 7105 applies to this project.

Response: The insurance requirements set forth in the referenced General Conditions Section 13 were intentionally drafted on behalf of the District and should not be considered leftover boilerplate language. For clarity, the District is requiring flood and earthquake insurance as defined in Section 13.1.5 Builder's Risk Insurance: Builder's Risk “All Risk” Insurance for this project. Pubic Contract Code section 7105 applies to construction contracts for projects for public agencies, including the District. However, Public Contract Code section 7105 does not prohibit the District from requiring a contractor to obtain insurance to indemnify the District for any damage to work caused by an act of God in excess of 5 percent of the contracted amount. The District’s specific insurance requirements for this project are set forth above and in the bid documents
