Question: Brenntag formally requests the removal of section 3, page 20, titled “Anti-Trust”. It is against the policy of Brenntag to assign anti-trust claims for several reasons. First, the assignment of anti-trust claims means that Brenntag would lose control over the pursuit of anti-trust claims involving Brenntag and any corresponding litigation involving Brenntag. Second, the assignment of anti-trust claims puts Brenntag at risk because it could jeopardize its defense to a related anti-trust claim against Brenntag. Thank you for your time and consideration.
