Question: March 2, 2023 Overhead Door Co. of Washington, DC - 8641 Virginia Meadows Drive, Manassas VA 20109 Arlington County 23-DES-ITB-556 Questions -Please clarify Bi-Monthly is defined as two times per month. -Section II.2- The Commonwealth of Virginia does not provide a Journeyman tradesman certification from the Virginia Board of Contractors for Overhead Door work. Please clarify. -Are any of the following negotiable: I.7 COVID-19 Vaccination Policy I.14 Discounts II.6 Inspection Reports II.7 New and Corrective Work- time and material II.11 Improper Maintenance,Repair AND/OR Operation-In-house repairs II.13 On-Call Service II.16 Material and Workmanship-All charges for materials for all contract work shall be at the contractor’s cost. Upon County request, the contractor must provide supporting invoices/receipts for materials. II.17 Additional Equipment Requirements II.22 Traffic Management II.23 Justice Center-locked tool bag and daily inventory of such III.7 Payment Terms- 5% retention III.14 Warranty- 1 year from final acceptance

Question: Section II "Scope of Services" Paragraph 3 Requires a Contractor to provide all "Materials, Parts, and Equipment" at COST. These "COSTS" are proprietary and are agreed upon between the Contractor and their suppliers. This requirement could and would cause the Contractor to violate standing NDA's with certain suppliers and manufacturers, by producing proprietary information to an end user. Other Local and State Governments have also attempted to use the same requirement in their ITB's, only to find that the base cost of their contracts doubles or in some cases triples. Is this a firm requirement for this ITB?

Response: Section II “Scope of Services” Paragraph 3 is titled “Service Requirements” all reference to materials and cost is as follows: “All charges for materials, parts and equipment shall be at the Contractor’s cost, and is reimbursable by the County, see section 8 “Project Work greater than ($10,000)” This language states that the charges for materials, parts and equipment shall be at the Contractor’s cost - no mark-ups are allowed. The requirement does not impact/violate NDA’s agreed into with suppliers or manufactures. Pricing information is required of all Contractor’s suppliers or subcontractor to perform work under this contract, please reference section 9 titled “Project Work (Work greater than $10,000)”, section 10 titled “SUBCONTRACTOR WORK”. AND section 16. “MATERIALS AND WORKMANSHIP”. As indicated in the Bid Form, Contractors are encouraged to provide fully loaded rates to cover overhead, consumables, profit etc.
