Description: SCOPE OF WORK The City of Carlsbad is seeking proposals for Weed and Debris Removal Services. These services are generally performed in response to the City Council’s actions regarding certain properties found to be menaces to the public comfort, health, peace and/or safety. The properties are found to be in such a condition that rubbish, wreckage and debris and/or weed must be removed from the City. The City has adopted resolutions pursuant to NMSA 1978 , Section 3-18-5 (1977) requiring the properties’ owners, occupants or agents in charge, to remove the rubbish, wreckage, debris and/or weeds. In the event that the properties’ owners, occupants, or agents in charge fail to comply with such resolutions, the City may remove the rubbish, wreckage, debris and/or weeds and clean the properties at the cost and expense of the owners, unless the property is owned by the City, in which case the City will pay to have the property cleared of all rubbish, wreckage, debris and/or weeds. Background New Mexico Law allows the Governing Body of municipalities to order the removal of weeds, debris and/or rubbish from properties, residential or commercial, which are unsightly, unsafe or which pose a hazard to the health, safety and welfare of the community. If the owners of the property in question fail to comply with the directives of the Governing Body, State Law empowers the City or its designee to enter upon the property and effect the removal of the weeds and/or debris to alleviate the undesirable condition. In lieu of utilizing City personnel and equipment, the City of Carlsbad seeks to engage the services of a qualified business to perform these services as become necessary from time to time. Bids are being requested for these services. Once approved by the City Council, the City and the successful bidder would enter into a general contract to perform the required work on an as needed basis.
