Question: On page 22, Section B, item 1, FCPS requests all potential contractors make an effort to include MWVBE as subcontractors. Are bidders who meet the MWVBE goal themselves required to make a good faith effort for MWVBE subcontractors?
Response: MWVBE vendors are not required to make an effort. Other vendors are not required to make an effort if the solicitation is for something that does not typically use sub contracting.

Question: May I have copies of the most recent fuel invoices for both the Liberty Road and Springhill Drive locations?
Response: In order to obtain these you would have to submit an open records request to our Legal Department.

Question: What is the average delivery size for each location?
Response: Springhill - We normally order two loads annually of approximately 7500- 7600 gallons each Liberty Rd - They have two 7500 gallon tanks on site. We don’t order until the tanks are pretty much empty. Typically we order twice a week. One order for each tank.

Question: 1. Will the OPIS average Rack prices for Lexington, KY be OPIS average low unbranded or average unbranded?
Response: Page 17 of bid document states: Pricing shall be based on RACK AVERAGE (also reported by OPIS as “RACK AVG”) terminal price as published by OPIS for the Lexington, KY region. Price shall be taken from OPIS end-of-day report for the date of delivery. FCPS realizes tax rates may change during the contract period due to Federal and State tax changes. However, should a tax rate change, successful bidder MUST PROVIDE WRITTEN NOTIFICATION that accompanies invoice.

Response: Background checks are not required since this service does not involve students.

Question: 5. Is there a local preference for this bid?
Response: In accordance with KRS 45A.490 to 45A.494, a resident Offeror of the Commonwealth of Kentucky shall be given a preference against a nonresident Offeror. In evaluating bids/proposals, Fayette County Public Schools will apply a reciprocal preference against an Offeror submitting a bid/proposal from a state that grants residency preference equal to the preference given by the state of the nonresident offeror. Residency and non-residency shall be defined in accordance with KRS 45A.494 (2) and 45A.494 (3), respectively. Any Offeror claiming Kentucky residency status shall submit with its proposal a notarized affidavit affirming that it meets the criteria as set forth in the above referenced statute.

Question: How often are the fuel samples being tested and what are they being tested for?
Response: A fuel sample is obtained from each delivery in the event we have catastrophic failures in multiple buses at the same time. The sample would then be sent and tested for abnormal minerals, foreign particles, etc….
